Investigators say Twin Falls shooting was self defense

The Twin Falls County Sheriff’s Office has concluded its investigation into the events on April 24, 2012, that led to the death of 42-year-old Jose Luis Mucio-Olayo of Murtaugh and has determined the shooting was in self defense.

According Sheriff’s Office spokeswoman Lori Stewart, at about 8:50 p.m. on the 24th, deputies were dispatched to 4808 East 2900 North for a report of a fight. They arrived on scene and found two men with gunshot wounds, an uninjured woman, and a car in flames.

Mucio-Olayo was airlifted to St. Luke’s Magic Valley Regional Medical Center where he later died. Javier Carbajal-Galvan, 28, was transported by ground to the hospital. A third victim, Edgar Trinidad-Garcia, 23, of Burley, left the scene before deputies arrived.

Since the incident, the Twin Falls County Sheriff’s Office and the Twin Falls County Prosecuting Attorney’s Office have worked to determine what happened and what, if any, charges should be filed.

The Sheriff’s investigation revealed that an argument developed between Mucio-Olayo, Carbajal-Galvan, and 25-year-old Raquel E. Martinez.

Investigators say Jose Mucio-Olayo fired a small caliber rifle at Javier Carbajal-Galvan at close range, hitting him several times.

Mucio-Olayo then turned the gun on Raquel Martinez and fired at her several times. Defending herself and Javier, Raquel Martinez fired a large caliber handgun at Jose Mucio-Olayo, fatally wounding him. A round also hit Edgar Trinidad-Garcia.

Sheriff’s investigators, in cooperation with the Prosecutor’s Office, have concluded that the actions taken by Raquel Martinez were justified as self-defense. No charges will be filed in this case.
