Idaho county agrees to settle road lawsuit
The federal government has agreed to settle its lawsuit against a central Idaho county after the county agreed not to try to reopen a remote mountain road closed by the U.S. Bureau of Land Management to protect the nearby Jerry Peak Wilderness Study Area.
But Custer County Commission Chairman Wayne Butts tells the Post Register that the move by the county is a maneuver he hopes will eventually lead to what he calls a more favorable range of outcomes concerning Herd Creek Road.
But in documents filed Friday in U.S. District Court, the county agreed to a range of stipulations that include not attempting to reopen the road.
The BLM closed the road in 1999. The county responded by asserting ownership, beginning a series of legal skirmishes.
