Lawsuit filed to drop Magic Reservoir level
A hydroelectric entity that generates power at a leaking reservoir in south-central Idaho has filed a lawsuit against a canal company seeking to force the canal company to drop the reservoir's level so the dam can be repaired.
Magic Reservoir Hydroelectric, a wholly-owned subsidiary of J.R. Simplot Co., filed the lawsuit Oct. 23 in 5th District Court against the Big Wood Canal Co.
The lawsuit seeks to have the reservoir in southern Blaine County lowered by about a third of its volume so repairs can be made.
Magic Reservoir Hydroelectric contends that Big Wood Canal Co. was supposed to start lowering the level of the reservoir last month.
The leak was found last year, and couldn't be fixed by divers.
