Bail kept at $100,000 for northern Idaho...

COEUR D'ALENE, Idaho (AP) -- A northern Idaho judge has kept bail at $100,000 for a male caretaker charged with sexually abusing a 102-year-old woman at a Spirit Lake area assisted-living facility.

Fifty-year-old Phillip R. Smalley of Spirit Lake is also charged with misdemeanor abuse or neglect of a vulnerable adult involving an 82-year-old woman who has since died.

The Coeur d'Alene Press reports that 1st District Court Judge Lansing Haynes made the decision Friday.

Smalley's defense attorney asked that Smalley be released on his own recognizance, but prosecutors say Smalley is a threat to the community.

Smalley has pleaded not guilty and says the touching was appropriate and within the scope of his duties.

A jury trial is scheduled for Jan. 19.
