A district court judge in Boise threw out a lawsuit against the city of Eagle. Attorney Jacob Deaton says the city's run-off ordinance was unclear and should not be valid. It also asked the judge to stop next week's match up between Saundra McDavid and Phil Bandy.
But the city's attorney, Susan Buxton, says the ordinance is clear, and city leaders were just following a statute set up by the Idaho legislature in 2003. The judge agrees with Eagle city leaders, but says the ordinance could have been written better.
