Accused murderer Bill Holmes was inside a Malheur County Courtroom for his second appearance before a judge. Holmes stands accused of murdering his wife, Janet Holmes inside their Nyssa home. The judge read off the grand jury indictment handed down in the case.
"Mr. Holmes the grand jury has returned an indictment against you they have charged you with murder that is an unclassified felony."
Court documents obtained by Today's Channel 6 detail what officer's say they found. The Deputy District Attorney wanted to talk more about the evidence in court but the defense wasn't prepared. Meantime the judge said she wanted to handle right now what appears to be a more pressing issue.
"I have some notes here from Mr. Holmes that would raise concerns just in it of themselves."
The attorney representing Bill Holmes says he and the state has concerns about the mental health of Holmes. The judge at the end of the arraignment ordered that the State Hospital in Salem, Oregon evaluate Holmes within 30 days and report back to the court.
"They are going to see if he can help in his defense and if he can't aid and assist then the matters are suspended until he is able to aid and assist", says Manuel Perez.
Once the 30 days is up the judge will decide on how to proceed with the case. Holmes is due back in court October 14th.
